4. What happens after we receive a notice

We may review the notice, request clarification, remove or disable access to the identified material where appropriate, and notify the person who provided the material if applicable. We may forward the notice or relevant information to that person so they can understand and respond to the claim.

Sending a notice does not guarantee a particular outcome. The process and any deadlines depend on the facts, applicable law, and whether the notice is complete.

5. How to submit a counter-notification

If material you provided was removed or disabled because of a copyright notice and you believe this resulted from a mistake or misidentification, you may send a written counter-notification to the designated agent. A counter-notification should include:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled and the location where it appeared before removal.
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled because of a mistake or misidentification.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the appropriate U.S. federal district court and will accept service of process from the person who submitted the original notice or that person’s agent. If you live outside the United States, the applicable jurisdiction statement may differ.

We may forward a counter-notification to the person who submitted the original notice. Under the DMCA process, material may be restored after the applicable waiting period unless the original complainant provides notice of a court action seeking to restrain the material. A counter-notification can have legal consequences; consider obtaining legal advice before submitting one.

6. Repeat infringement

Where appropriate and as permitted by law, TechKTimes may restrict or terminate access for people who repeatedly infringe copyright or other intellectual property rights.

7. False or incomplete claims

Copyright notices and counter-notifications are serious legal statements. Knowingly making material misrepresentations may lead to legal consequences. Please submit only accurate information and only if you are authorized to do so.

8. Third-party material

TechKTimes may link to or refer to material hosted by another website. If the material is hosted by a third party, you may also need to contact that provider. We cannot remove material from a website or service that we do not control.
